Action by Frank Wojciechowski to recover damages for personal injuries he sustained when struck by an automobile driven by
Anthony J. Baron. On July 18, 1953, at about 11 p. m. the plaintiff was walking south on Highway 141, a three-lane highway. The defendant Baron
was driving north on said highway. There was a conflict in the testimony as to where the plaintiff was walking. He testified
that he was walking on the east edge of the concrete and when the automobile driven by Baron approached he stepped off the
concrete portion of the highway and that he was on the shoulder when struck. Baron and his witnesses testified that the plaintiff
was walking near the line dividing the center lane of the highway from the east lane thereof, and that he was occupying the
east lane of the highway when struck. When he saw plaintiff Baron applied his brakes and turned his car sharply to the left.
Plaintiff was struck by the right edge of the rear bumper and his left leg was so severely injured that it had to be amputated.
