Shelly Frank appeals from the district courts judgment dismissing her suit for lack of subject-matter jurisdiction. Frank had obtained an adverse decision of a Texas Workers Compensation Commission hearing examiner and then requested review by the Commissions appeals panel. The appeals panel concluded that Frank had failed to timely file her request for review and dismissed her administrative appeal. Frank then sued in district court for judicial review of the appeals panels order. The carrier, Liberty Insurance Corporation, moved to dismiss Franks suit for lack of subject-matter jurisdiction, urging that Frank had failed to exhaust her administrative remedies by timely seeking appeals panel review. The district court granted Libertys motion.
